2022年12月7日から19日まで、カナダ・モントリオールにおいて、生物多様性条約第15回締約国会議(COP15)第二部が開催され、「ポスト2020生物多様性枠組」の採択に向けた最終的な交渉が行われました。

その注目の議題のひとつが「デジタル配列情報(Digital sequence information; DSI)」であり、塩基配列のような配列情報までも生物多様性条約・名古屋議定書で取り扱う「遺伝資源」と捉えて「遺伝資源の利用から生ずる利益の公正かつ衡平な配分(Access to genetic resources and Benefit-Sharing; ABS)」の対象とするのかどうか、もしその対象とするのであればどのような仕組みとすべきなのか、について激しい議論が締約国間でなされてきました。

そして、今回、締約国会議は、遺伝資源のデジタル配列情報の使用から得られる利益が公正かつ衡平に配分されるべきであることに合意し、多国間メカニズム(グローバルファンドを含む)を構築して、第16回締約国会議において最終化することを決定する、という内容を採択するに至ったようです。

Recognizing the different understandings of the concept and scope of digital sequence information on genetic resources, and the range of views regarding the need to define such concept and scope,(遺伝資源のデジタル配列情報の概念と範囲、およびそのような概念と範囲を定義する必要性に関する見解の範囲に異なる理解があることを認識して、)

1. Agrees on the continuing use of the term “digital sequence information” for further discussions;(今後の議論に「デジタル配列情報」という用語を継続して使用することに合意する。)

2. Also agrees that the benefits from the use of digital sequence information on genetic resources should be shared fairly and equitably;(また、遺伝資源のデジタル配列情報の使用から得られる利益は、公正かつ衡平に配分されるべきであることに同意する。)

8. Agrees to develop a solution for the sharing of benefits arising from the use of digital sequence information on genetic resources;(遺伝資源のデジタル配列情報の使用から生じる利益の配分のための解決策を開発することに合意する。)

9. Also agrees that a solution for fair and equitable benefit-sharing on digital sequence information on genetic resources should, inter alia:(また、遺伝資源のデジタル配列情報に関する公正かつ衡平な利益配分のための解決策は、特に以下の通りであることに合意する。)

(a) Be efficient, feasible and practical;(効率的で、実現可能で、実用的であること。)
(b) Generate more benefits, including both monetary and non-monetary, than costs;(金銭的、非金銭的なものを含め、コストよりも多くの利益を生み出すこと。)
(c) Be effective;(効果的であること。)
(d) Provide certainty and legal clarity for providers and users of digital sequence information on genetic resources;(遺伝資源のデジタル配列情報の提供者と利用者に確実性と法的明確性を提供する。)
(e) Not hinder research and innovation;(研究・イノベーションを妨げないこと。)
(f) Be consistent with open access to data;(データへのオープンアクセスに整合していること。)
(g) Not be incompatible with international legal obligations;(国際的な法的義務と相容れないものでないこと。)
(h) Be mutually supportive of other access and benefit-sharing instruments;(他のアクセス権および利益配分手段を相互に支援すること。)
(i) Take into account the rights of indigenous peoples and local communities, including with respect to the traditional knowledge associated with genetic resources that they hold;(先住民および地域社会が持つ遺伝資源に関連する伝統的知識に関するものを含め、先住民および地域社会の権利を考慮すること。)

10. Recognizes that the monetary and non-monetary benefits arising from the use of digital sequence information on genetic resources should, in particular, be used to support conservation and sustainable use of biological diversity and, inter alia, benefit indigenous peoples and local communities;(遺伝資源のデジタル配列情報の使用から生じる金銭的及び非金銭的利益は、特に、生物多様性の保全と持続可能な利用を支援し、とりわけ、先住民及び地域社会の利益になるように利用されるべきであることを認識する。)

11. Agrees that the approach set out in this decision to fair and equitable benefit-sharing from the use of digital sequence information on genetic resources does not affect existing rights and obligations under the Convention and the Nagoya Protocol, including, as applicable, those related to traditional knowledge and the rights of indigenous peoples and local communities, and is without prejudice to national access and benefit-sharing measures;(遺伝資源のデジタル配列情報の利用から公正かつ衡平な利益配分のために本決定で示されたアプローチは、該当する場合、伝統的知識及び先住民並びに地域社会の権利に関するものを含め、本条約及び名古屋議定書の下で既存の権利及び義務に影響せず、各国のアクセス及び利益配分措置を害するものではないことに合意する。)

16. Decides to establish, as part of the post-2020 global biodiversity framework, a multilateral mechanism for benefit-sharing from the use of digital sequence information on genetic resources, including a global fund;(ポスト2020生物多様性枠組の一部として、遺伝資源のデジタル配列情報の使用による利益配分のための多国間メカニズム(グローバルファンドを含む)を構築することを決定する。)

17. Also decides to establish a fair, transparent, inclusive, participatory and time-bound process to further develop and operationalize the mechanism, as outlined in paragraphs 18 and 20 to 22 below, to be finalized at the sixteenth meeting of the Conference of the Parties;(また、以下のパラグラフ18及び20から22に概説するとおり、メカニズムを更に発展させ運用するための公正、透明、参加型、期限付きのプロセスを確立し、第16回締約国会議において最終化することを決定する。)

18. Establishes an ad hoc open-ended working group on benefit-sharing from the use of digital sequence information on genetic resources to undertake further development of the multilateral mechanism, including the elements identified in the annex, and to make recommendations to the Conference of the Parties at its sixteenth meeting;(遺伝資源のデジタル配列情報の使用から得られる利益配分に関するアドホック・オープンエンド・ワーキンググループを設置し、附属書で特定された要素を含む多国間メカニズムの更なる開発を行い、第16回締約国会議に対して勧告を行う。)

19. Decides to review the effectiveness of the multilateral mechanism at the eighteenth meeting of the Conference of the Parties, including, inter alia, the criteria laid out in paragraphs 9 and 10;(第18回締約国会議において、特にパラグラフ9及び10に示された基準を含め、多国間メカニズムの有効性をレビューすることを決定する。)

とうとう、「デジタル配列情報」という情報までもが「遺伝資源」の対象とされ、その情報の使用から得られる利益も配分される多国間メカニズムを構築することが決定されました。

しかし、具体的なメカニズムの構築については、第16回締約国会議までに最終化、つまり先送りともいえます。

「遺伝資源のデジタル配列情報」のアクセスや利益配分の義務がいつ、どのように発生するのか、多国間メカニズムは一体どのようなもので、どのように機能するのかなど、まだまだ議論・解決されなければならない多くの問題が山積みであるように思われます。
