2025年11月6日、大塚ホールディングス傘下の大鵬薬品工業株式会社（Taiho Pharmaceutical Co., Ltd.、以下「大鵬薬品」）及びTaiho Oncology, Inc.は、抗悪性腫瘍剤LYTGOBI®（リトゴビ®、一般名：futibatinib（フチバチニブ））に関する米国特許期間延長（Patent Term Extension, PTE）出願の拒絶を不服として、米国特許商標庁（USPTO）を相手取り、米国ニュージャージー州連邦地裁に提訴したようです（Taiho Pharmaceutical Co., Ltd. et al v. Squires et al（No. 3:25-cv-17280, D.N.J.））。

FDA承認とPTE出願
LYTGOBI®は、FGFR（線維芽細胞増殖因子受容体） 1、2、3、4を選択的に阻害する経口チロシンキナーゼ阻害剤であり、2022年9月30日、米国FDAから「前治療歴を有するFGFR2融合遺伝子またはその他の再構成を伴う切除不能な局所進行または転移性肝内胆管がん」の適応で承認を受けました（NDA214801: Approval Letter）。
その後、大鵬薬品は本剤の有効成分に係る米国特許第9,108,973号（化合物に関する発明、20年+PTA後の満了日は2033年2月13日）及び第10,434,103号（結晶形に関する発明、20年満了日は2036年3月31日）について、2022年11月29日に特許期間延長（PTE）を出願しました（いずれも2036年9月30日までの延長期間を主張）。
USPTOによる「1日遅れ」判断
しかし、USPTOは大鵬薬品のPTE出願を「FDA 承認日から60日以内に提出されていないため不適格（untimely）」と判断しました。
“Thus, the date of notice of a product’s regulatory approval both triggers the sixty-day period and is day one of the sixty-day period to submit a PTE application. The day after triggering event would be the second day of the sixty-day period. For LYTGOBI®, the FDA transmitted its approval during business hours (September 30, 2022 at 12:08:07 PM). Because this notification was given on a business day (Friday) before 4:30 pm Eastern Time (at 12:08:07 PM), the “next business day” proviso does not apply to the sixty-day calculation. This meant that September 30, 2022 was the first day of the sixty-day period and November 28, 2022 was the last day of the sixty-day period. As a result, Applicant’s November 29, 2022 PTE submission was one day late and, so, untimely. In its January 24, 2024 letter, the FDA likewise confirmed that the PTE application filed on November 29, 2022 was untimely based on its official records.”

要するに、FDAが承認通知を2022年9月30日（金）午後4時30分（Eastern Time）前に通知していたため、その日が「第1日目」とされ、60日目は2022年11月28日（月）となりました。このため、11月29日提出のPTE出願は1日遅れと判断されたのです。
以下のとおり、35 U.S.C.§156(d)(1)には、承認日から始まる60日以内にPTE出願をしなければならず、営業日の午後4時30分（Eastern Time）の後に承認通知を受けた場合は次の営業日に当該通知を受けたとみなす旨が定められています。
“(d)(1) To obtain an extension of the term of a patent under this section, the owner of record of the patent or its agent shall submit an application to the Director. Except as provided in paragraph (5), such an application may only be submitted within the sixty-day period beginning on the date the product received permission under the provision of law under which the applicable regulatory review period occurred for commercial marketing or use, or in the case of a drug product described in subsection (i), within the sixty-day period beginning on the covered date (as defined in subsection (i)). The application shall contain— …
For purposes of determining the date on which a product receives permission under the second sentence of this paragraph, if such permission is transmitted after 4:30 P.M., Eastern Time, on a business day, or is transmitted on a day that is not a business day, the product shall be deemed to receive such permission on the next business day. For purposes of the preceding sentence, the term ‘‘business day’’ means any Monday, Tuesday, Wednesday, Thursday, or Friday, excluding any legal holiday under section 6103 of title 5.”
FDAの承認日（approval date）は公式記録上9月30日とされていますが、大鵬薬品は当初の承認通知書に誤記があり、10月5日付で訂正版が送付されたことを根拠に、実質的な承認完了日は10月5日であると主張しているようです。この「起算日をどこに置くか」という点が、今回の訴訟の核心となる可能性があります。
大鵬薬品は特許延長出願期限60日の起算日が承認日であるところ、その翌日からであると勘違いしてしまったということなのでしょうか。それとも誤記訂正版が承認通知だと勘違いしたのでしょうか。この延長期間を失うと製品独占期間に大きな影響が出そう・・・
